In these terms, Cinetales Photography refers to Prashant Gautam and any photographer, videographer, editor, assistant or contractor engaged to complete the booked service. The Client refers to the person or business making the booking.

Confirming a booking, paying an advance or allowing the shoot to begin means the Client accepts these terms together with the final written quotation.

A date is considered confirmed only after the required advance payment has been received and acknowledged by Cinetales Photography.

• A verbal discussion or enquiry does not reserve a date.
• The booking applies only to services stated in the approved quotation.
• Additional hours, photographers, videos, albums, edited images or deliverables may be charged separately.

The Client acknowledges that photography is a creative service. Cinetales Photography will work according to its professional experience, visual style and requirements discussed before the shoot.

• A particular photograph, pose, expression, moment or result cannot be guaranteed unless agreed in writing and practically possible.
• Final composition, lighting, image selection, colour treatment and editing style remain professional creative decisions.
• The number of photographs captured may differ from the number finally selected or edited.

The Client is responsible for providing accurate information about the date, time, venue, products, participants, schedule and photography requirements.

• Venue permissions, entry passes and photography approvals must be arranged by the Client.
• Product clients must ensure products are clean, complete and shoot-ready unless styling has been included.
• Personal-shoot clients must arrive on time with agreed clothing, accessories and participants.
• Client or venue delays may reduce the available shooting time.

Subject to applicable law and the written quotation, the parties agree that Cinetales Photography retains copyright and creative ownership unless a separate written transfer of rights has been purchased.

Personal photography: Clients may download, print and share delivered photographs for personal, non-commercial use. Images must not be sold, licensed or presented as another photographer’s work.

Product and commercial photography: Commercial usage is permitted only for the brand, platforms, campaign, duration and purposes covered by the approved quotation. Broader advertising or third-party licensing may require a separate commercial licence.

Cinetales Photography may request permission to display selected work on its website, social media, studio samples, advertisements or portfolio.

Clients requiring privacy should communicate this before the shoot or in writing before delivery. Private images will not be published where confidentiality has been expressly agreed.

Images involving children, sensitive personal occasions or confidential commercial products will be handled according to the consent and privacy conditions agreed with the Client.

Cinetales Photography maintains a respectful and safe environment for clients, children, guests and team members.

• The team may pause or stop services where conditions are unsafe, unlawful, abusive, threatening or damaging to equipment.
• Children must remain supervised by a parent or responsible guardian during studio and outdoor sessions.
• The Client is responsible for damage caused intentionally or negligently by the Client, guests or representatives.

Performance may be affected by circumstances outside reasonable control, including severe weather, venue restrictions, illness, accidents, government restrictions, power failures or unexpected technical problems.

If a complete loss of commissioned work occurs due to circumstances for which Cinetales Photography is legally responsible, available remedies will be determined by the written agreement and applicable law. To the extent legally permitted, financial liability will not exceed the amount paid for the affected service.

The approved quotation forms part of the booking agreement. If a project-specific written condition differs from these general website terms, the condition in the final quotation or signed agreement will apply to that booking.

Changes to services or deliverables must be confirmed in writing. Informal discussions not included in the final quotation should not be treated as confirmed deliverables.

Cinetales Photography uses professional cameras, memory cards, hard drives, computer systems and online file-sharing platforms while capturing, processing, storing and delivering client work. Reasonable professional care and backup practices will be used; however, no digital storage system can be guaranteed to remain completely free from technical failure.

Unavoidable technical issues may include:

• Camera, recording-device or equipment malfunction during the shoot.
• Memory-card failure, corruption, physical damage or unreadable files.
• Computer, editing-system, hard-drive or storage-device failure.
• File corruption occurring during copying, processing, compression, upload or download.
• Temporary or permanent problems involving Google Drive, online galleries, cloud-storage providers, internet services or other third-party delivery platforms.
• Files being deleted, misplaced or corrupted on the Client’s phone, computer, drive, online account or other personal storage system after delivery.

Cinetales Photography will not be responsible for delays, corruption, unavailability or loss caused exclusively by a third-party platform, the Client’s device, the Client’s storage practices or another technical circumstance outside the reasonable control of Cinetales Photography.

Where the agreed files were successfully delivered or made available for download, such third-party or Client-side technical loss will not create an entitlement to a refund. Any request to restore or re-upload files may be chargeable and will remain subject to the files still being available in the Cinetales Photography archive.

Clients must download all delivered files within the stated download period and immediately create at least two independent backup copies. Cinetales Photography does not provide permanent or indefinite storage of completed projects.

Nothing in this clause excludes any responsibility that cannot legally be excluded under applicable law. If a problem results directly from proven negligence by Cinetales Photography, it will be handled under Point 8, the written booking agreement and applicable law.
